WHEREAS, Section 34-36 of the Code of the Township of South Brunswick provides for the appointment of up to three judges of the Municipal Court of South Brunswick, one to be designated as the Chief Judge, with each judge serving a term of three years from the date of appointment and until a successor shall be appointed and qualified; and
WHEREAS, N.J.S.A. 2B:12-4(b) provides that in all municipalities, other than those governed by a Mayor-Council form of government, the municipal judge(s) shall be appointed by the governing body of the municipality; and
WHEREAS, the Township wishes to award a contract for these services by following a “fair and open process”, as defined by N.J.S.A. 19:44A-20.4 et seq.; and
WHEREAS, the Township publicly advertised for this contract by posting a Request for Qualifications ten (10) days prior to the award of the contract, in order to qualify persons that (a) possesses the professional, financial and administrative capabilities to provide the proposed services, and (b) obtain the terms and conditions determined by the Township to provide the greatest benefit to the taxpayers of South Brunswick; and
WHEREAS, after reviewing the responses to the Request for Qualifications, the Township has determined that Michael V. Dowgin, Esq., has demonstrated the capability and willingness to provide high quality services to the citizens of the Township in the manner described in the Request for Qualifications; and
WHEREAS, Michael V. Dowgin, Esq., has agreed to provide the necessary services required as the Chief Municipal Judge;
NOW, THEREFORE, BE IT RESOLVED on this 24th day of January 2012, by the Township Council of the Township of South Brunswick, County of Middlesex, State of New Jersey, that:
1. Michael V. Dowgin, Esq., be and is hereby appointed as Chief Judge of the Municipal Court of the Township of South Brunswick for a three year term, said term to expire January 23, 2015.
2. The Mayor and Township Clerk are hereby authorized to execute the agreement governing said appointment, a copy of which shall be kept on file with the Township Clerk.
3. This appointment is contingent upon the filing of a financial disclosure and non-conflict of interest form with the Township Clerk.
4. The contract is awarded under the provisions of the Local Unit Pay-To-Play Law (N.J.S.A. 19:44A-20.4 et seq.)
