WHEREAS, the South Brunswick wastewater system includes a 24" sanitary sewer force main located near the Route 1 and Route 18 intersection in New Brunswick, NJ; and

 

WHEREAS, On August 15, 2017, at approximately 9:30a.m., while doing their daily check of the MCUA #2 Meter Chamber and the site of a temporary force main repair, staff observed a collapse in our 24” sanitary sewer force main. The sanitary sewage was flowing down the parking lot and into a storm drain leading to the Raritan River; and

WHEREAS, North Brunswick Sewer Division was immediately notified of the situation, and agreed to begin diverting as much sanitary sewer flow to their system as possible; and

WHEREAS, a contract was previously awarded to Montana Construction to provide emergency work for a total contract amount not to exceed $190,000.00 by way of a resolution dated April 4, 2017; and

WHEREAS, the contract with Montana Construction was increased by way of a resolution dated June 27, 2017, increasing the contract an additional $210,000.00, for a total contract amount of $400,000.00; and

WHEREAS, a contract was previously awarded to John Holm & Son to provide pump work for the emergency repairs for a total contract amount not to exceed $30,000.00 by way of a resolution dated April 4, 2017; and

WHEREAS, upon further inspection, it was found that the location of the failure is in a section of the line which failed back on March 21, 2017, also requiring an emergency temporary repair. The permanent repair/replacement of the line was to be performed on August 23, 2017; and

              WHEREAS, Montana Construction has indicated that follow-up work is necessary which will require installation of an additional 200 feet of 24” C-900 PVC pipe, as well as 200 feet of additional bypass pipe which will now have to be buried due to the location, for an increase in the amount of the contract of$460,000.00, bringing the total contract for Montana Construction to $860,000.00; and

              WHEREAS, John Holm & Son has also indicated that pumping work will be necessary, for an increase in the amount of the contract not to exceed $30,000.00, bringing the total contract for John Holm & Son to $60,000; and

 

WHEREAS, N.J.S.A. 40A:11-6 allows a municipality to award a contract on an emergency basis without public advertising for bids and bidding; and

 

              WHEREAS, the Sewer Division Supervisor has certified that an emergency condition existed and has recommend that the Township authorize/ratify the execution of emergency contracts to pay for the immediate repairs that had to be made to the sewer main; and

WHEREAS, funds are available for these emergency contracts and a certification of availability of funds has been provided by the Township Treasurer from Ord. 21-11, Account #08-215-11-2111-810 by Joseph P. Monzo/jmb; And

WHEREAS, the Township Manager has certified that the changes in this request are within the scope of activities of the original contract and not for the purpose of undertaking new or different work or projects and that the proposed work is allowable under Local Finance Board and Division of Local Government Services Regulations;

 

WHEREAS, the Department of Law is satisfied that said certification is in proper form;

 

              NOW, THEREFORE, BE IT RESOLVED on this 22nd day of August, 2017, by the Township Council of the Township of South Brunswick, County of Middlesex, State of New Jersey, that:

 

.            An emergency contract shall be and is hereby authorized and ratified with John Holm & Son in an amount not to exceed $15,000.00 for the emergency pump work needed and additional pump out work in an amount not to exceed $15,000.00, for a total emergency contract amount of $30,000.00, for repairs to the sanitary sewer force main located near the Route 1 and Route 18 intersection in New Brunswick, NJ.

.            The original contract amount awarded to John Holm & Son shall be and is hereby increased an additional $30,000.00, for a total contract amount of $60,000.00.

.            An emergency contract shall be and is hereby authorized and ratified with Montana Construction in an amount not to exceed $50,000.00 for the emergency work needed and additional work in an amount not to exceed $410,000.00, for a total emergency contract amount of $460,000.00, for repairs to the sanitary sewer force main located near the Route 1 and Route 18 intersection in New Brunswick, NJ

.            The original contract amount awarded to Montana Construction shall be and is hereby increased an additional $460,000.00, for a total contract amount of $860.000.00.

.            The contracts are awarded pursuant to N.J.S.A. 40A:11-6, which allows a municipality to award contracts on an emergency basis without public advertising for bids and bidding.

.            The amounts of these contracts shall be charged to Ord. 21-11, Account #08-215-11-2111-810.
