Amending and Supplementing South Brunswick Code Chapter 114, Utilities, Eliminating the Requirement for an Industrial Sewer Service Agreement

WHEREAS, the Township maintains South Brunswick Code Chapter 114, Utilities, which sets forth the standards, regulations and rates for water and sewer services; and


              WHEREAS, the Utilities Supervisor has recommended changes to this section of the Code to eliminate the requirement of a formal, written agreement for Industrial Service; and


              WHEREAS, the Township Council believes that such charges are in the best interests of the Township;


              NOW THEREFORE BE IT ORDAINED by the Township Council of the Township of South Brunswick, County of Middlesex, State of New Jersey, that:


I.              Chapter 114 of the South Brunswick Code shall be and is hereby amended and supplemented as follows, with additions in underline and deletions in strikethrough:


Section 114-38. Sewer service.


(i). General regulations. General sewer service regulations shall be as follows:

(13) Industrial agreementservice. Service to Aan industrial agreement facility is shall required as the followsing:

a.  The township will accept industrial wastes into the sanitary sewer system upon the execution of a formal written agreement approval by the Township Utilities Department of an application for service, and under and subject to the provisions appearing in the agreement and this subsection. The agreement will application must set out, in detail, the characteristics of the wastes, the flow conditions which shall govern and the conditions with respect to the physical connection. It will be the policy of the township to consider each application on its own merits and to establish specific conditions applicable to the particular situation for each agreement application. No connection shall be made prior to execution of the agreement written approval by the Utilities Department and satisfaction of any conditions required for connection.


(17) Preliminary treatment. Preliminary treatment may be required as follows:

d.  Each industry connected shall be responsible for maintaining a quality of effluent from its premises which conforms to the provisions established in its agreement with the township the South Brunswick Utilities Code of Ordinances. Sampling and analysis shall be done to conform to accepted practice and in accordance with the current edition of Standard Methods for the Examination of Water and Wastewater, published by the American Public Health Association, the American Water Works Association and the Water Environment Federation.

e.  The cost of preparing and submitting this data for consideration by the township shall be borne by the industry. Likewise, the cost of sampling and analysis to determine compliance with the terms of the agreement established limits outlined in the South Brunswick Utilities Code of Ordinances Sec. 114-63 shall be borne by the industry, although conducted by the director and/or the sewer operation division supervisor. Invoices for Industrial sampling performed by the township will be sent on a quarterly basis for lab analysis of wastewater samples to be performed at a NJ certified laboratory.


(23) Penalty or discontinuance. If any industry fails to conform to the regulations in this subsection or fails to comply with the terms and conditions of its agreement with the township any terms set forth in the South Brunswick Township Utilities Code of Ordinances, which failure causes damage of any sort to the township or the township’s employees, the township shall determine the extent of the damage and bill the industry accordingly. If such bill is not paid within five calendar days from the date of the bill, legal action may be instituted to enforce collection, or the township may resort to termination of the connection after giving 24 hours’ notice or to termination of the water supply. The township reserves the right to cancel the agreement terminate sanitary sewer service upon one year’s written notice for repeated failure to comply with the terms of the agreement or the rules and regulations of the township.



II.              If any clause, sentence, paragraph, section or part of this ordinance or any other codes or ordinances incorporated herein shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder hereof, but shall be confined in its operation to the clause, sentence, paragraph, section or part thereof directly involved in the controversy in which said judgment shall have been rendered.


III.              This ordinance shall become effective twenty (20) days after its final passage.


The above ordinance was introduced and passed on first reading at a regular meeting of the Township Council of the Township of South Brunswick held on August 22, 2017, and will be considered on second and final reading and final passage at a regular meeting of the Township Council of the Township of South Brunswick to be held at the Municipal Building, Monmouth Junction, New Jersey, at 7:30 p.m. on September 26, 2017, at which time and place any person having an interest therein will be given an opportunity to be heard.
