Approving the Proposed Affordable Housing Compliance Mechanism for Toll Bros., for the Residential Development Located at Block 85, Lots 2.102, Et Seq., and Block 85.01, Lot 12.01 (Mindel Property)

WHEREAS, South Brunswick Code Section 62-2002 requires that a developer provide evidence of an affordable housing compliance mechanism acceptable to the Township as part of any application for development; and 

 

Whereas, Toll Brothers, Inc., has submitted to the South Brunswick Zoning Board of Adjustment an application for 85 single-family homes on property located at Block 85, Lots 2.102, et seq., and Block 85.01, Lot 12.01 (Mindel Property); and

 

WHEREAS, the developer has indicated that it will comply with its affordable housing obligation with the on-site production of 11 affordable housing units, for a set-aside of 12.9 percent, which exceeds the amount required, pursuant to the requirements of the Township Code;

 

NOW, THEREFORE, BE IT RESOLVED, on this 22nd day of August, 2017, by the Township Council of the Township of South Brunswick, County of Middlesex, State of New Jersey, that:

1.   The Township Council hereby approves of the affordable housing compliance mechanism proposed by Toll Brothers, Inc., for the proposed development referenced above, conditioned upon compliance with the South Brunswick Township Code, Council on Affordable Housing (COAH)’s rules and Uniform Housing Affordability Controls (UHAC) requirements including, but not limited to, the schedule of affordable housing production, phasing, bedroom distribution, controls on affordability, range of affordability, affirmative marketing, income qualification, etc.

2.   A copy of this Resolution be forwarded to the South Brunswick Zoning Board of Adjustment and Toll Brothers, Inc.
